Article 1 : Dispositions générales
Le site Web d’e-commerce de CREA-COM BV, une SP dont le siège social est établi à 3010 Leuven, Trolieberg 82, TVA BE 0729.718.627, RPM Leuven/Louvain, donne à ses clients la possibilité d’acheter en ligne les produits de sa boutique en ligne.
Les présentes Conditions générales (« Conditions ») s’appliquent à toute commande passée par un visiteur de ce site Web d’e-commerce (« Client »). Tout Client passant une commande par l’intermédiaire de la boutique en ligne de CREA-COM BV doit accepter expressément ces Conditions et consent ainsi à l’applicabilité desdites Conditions, à l’exclusion de toutes les autres conditions. Les conditions additionnelles du Client sont exclues, sauf si elles ont été expressément acceptées par écrit au préalable par CREA-COM BV.
Article 2 : Prix
Tous les prix mentionnés sont exprimés en EURO et incluent systématiquement la TVA et tous les autres impôts ou taxes à assumer obligatoirement par le Client.
Les frais administratifs, de livraison ou de réservation éventuellement facturés sont mentionnés séparément.
L’indication du prix se rapporte exclusivement aux articles formulés mot à mot. Les photos correspondantes sont intégrées à titre illustratif et peuvent inclure des éléments qui ne sont pas compris dans le prix.
Article 3 : Offre
En dépit du fait que la boutique en ligne et le site Web d’e-commerce sont réalisés avec le plus grand soin, il se peut que les informations fournies soient incomplètes, comportent des erreurs matérielles ou ne soient pas à jour. Les méprises ou erreurs manifestes dans l’offre n’engagent pas la responsabilité de CREA-COM BV. En ce qui concerne l’exactitude et l’exhaustivité des informations proposées, CREA-COM BV est uniquement tenu à une obligation de moyens. La responsabilité de CREA-COM BV n’est en aucune façon engagée en cas d’erreurs matérielles, typographiques ou d’impression manifestes.
Si le Client a des questions spécifiques au sujet, par exemple, de la disponibilité ou du délai ou du mode de livraison, nous l’invitons à prendre contact au préalable avec notre service clients.
L’offre est valable jusqu’à épuisement des stocks et peut à tout moment être adaptée ou supprimée par CREA-COMBV. CREA-COM BV ne peut être tenu responsable de la non-disponibilité d’un produit. Si une offre a une durée de validité limitée ou est effectuée sous conditions, ces informations sont explicitement mentionnées dans l’offre.
Article 4 : Achats en ligne
Description de la procédure de commande :
· Le Client dépose le produit choisi dans son panier
· Le Client termine sa commande et règle le montant (choix entre différents modes de paiement)
· Le Client reçoit le produit (abonnement) selon la période choisie ; le Client reçoit un mail de confirmation contenant la date de début et de fin de l’abonnement choisi/ pour l’achat d’un cours la date sera choisie en commun accord (CREA-COM BV garantit que le cours aura lieu dans les 30 jours après commande/paiement, dans le cas contraire le montant total sera remboursé au Client).
Le Client peut choisir parmi les modes de paiement suivants
· carte de crédit
· carte bancaire
· virement sur le compte n° BE 19 7360 5633 2412
CREA-COM BV est habilité à refuser une commande à la suite d’un manquement grave du Client en ce qui concerne les commandes où le Client en question est impliqué.
Article 5 : Livraison et exécution du contrat
Après avoir passé commande d’un abonnement, le Client reçoit un mail de confirmation de CREA-COM BV contenant la date de début et de fin de l’abonnement. Si le Client souhaiterait recevoir l’abonnement à une autre adresse mail que celle ayant servie pour passer la commande, il suffit d’en informer CREA-COM BV via aurelie@crea-com.be .
Lorsque le Client commande un cours, CREA-COM BV prendra contact via mail pour fixer une date et une heure de cours concrètes. CREA-COM BV garantit que le cours aura lieu dans les 30 jours après paiement du cours, dans le cas contraire le montant total du cours sera remboursé au Client.
Les articles commandés par l’intermédiaire de cette boutique en ligne sont livrés dans tous les pays ; les produits (abonnements) sont livrés digitalement par mail.
La livraison est effectuée via mail (abonnements) ou vidéoconférence (cours).
Un problème visible et/ou un défaut qualitatif d’un article ou tout autre manquement concernant la livraison doivent être signalés sur-le-champ par le Client à CREA-COM BV.
Article 6 : Réserve de propriété
Les articles livrés restent la propriété exclusive de CREA-COM BV jusqu’au moment du paiement intégral par le Client.
Le Client ne peut d’aucune façon diffuser, copier ou transmettre les documents de l’abonnement.
Article 7 : Droit de rétractation
Les dispositions du présent article s’appliquent exclusivement aux Clients qui achètent, en leur qualité de consommateurs, des articles en ligne chez CREA-COM BV.
Le Client a le droit d’annuler le contrat sans donner de motif dans un délai de quatorze jours calendrier.
Le délai de rétractation expire quatorze jours calendrier après la date de conclusion du contrat.
Afin d’exercer son droit de rétractation, le Client doit informer CREA-COM BV, Trolieberg 82 à 3010 Leuven, + 32 16 503950, aurelie@crea-com.be par une déclaration sans équivoque (par exemple une déclaration écrite par la poste ou par e-mail) de sa décision d’annuler le contrat.
Afin de respecter le délai de rétractation, le Client doit envoyer sa communication concernant l’exercice de son droit de rétractation avant l’expiration du délai de rétractation.
Si le Client a demandé que l’exécution des services débute durant le délai de rétractation, il doit payer un montant équivalent à ce qui avait déjà été fourni – par comparaison à l’exécution totale du contrat – au moment où il nous a informés qu’il annulait le contrat.
En cas d’annulation du contrat par le Client, CREA_COM BV remboursera au Client tous les paiements reçus du Client jusqu’à ce moment dans un délai maximum de quatorze jours calendrier après que CREA-COM BV a été informé de la décision du Client d’annuler le contrat.
CREA-COM BV rembourse le Client avec le même moyen de paiement que celui utilisé par le Client pour la transaction initiale, sauf si ce dernier a explicitement accepté d’autres modalités ; des frais ne pourront en aucun cas être imputés au Client pour ce remboursement.
Le Client ne peut exercer un droit de rétractation pour :
· les contrats de service après l’exécution intégrale du service ;
· la livraison de biens fabriqués en fonction de spécifications du Client ou qui sont clairement destinés à une personne spécifique (abonnement sur mesure) ;
· la fourniture d'un contenu numérique non fourni sur un support matériel si l'exécution a commencé avec l'accord préalable explicite du Client, lequel a également reconnu qu'il perdra ainsi son droit de rétractation ;
Article 8 : Garantie
En vertu de la loi du 21 septembre 2004 relative à la protection des consommateurs en cas de vente de biens de consommation, le consommateur bénéficie de droits légaux. Cette garantie légale s’applique à compter de la date de livraison au premier propriétaire. Aucune garantie commerciale ne modifie ces droits.

Si nécessaire, vous pouvez également demander la rectification des données éventuellement incorrectes, incomplètes ou non pertinentes.

Article 14 : Modification de conditions
Ces Conditions sont complétées par d’autres conditions auxquelles il est explicitement fait référence et les conditions générales de vente de CREA-COM BV. En cas de contradiction, les présentes Conditions priment.
Article 15 : Preuve
Le Client consent à ce que des communications électroniques et des sauvegardes puissent faire office de preuves.
Article 16 : Droit applicable - Juge compétent
Le droit belge est applicable, à l'exception des règles de droit international privé concernant le droit applicable et à l'exception de la Convention de Vienne sur les contrats de vente internationale de marchandises. Sauf si le Client est un consommateur, seuls les tribunaux de l’arrondissement de LEUVEN/LOUVAIN sont compétents en cas de litige.

Article 1: General provisions
The e-commerce website of CREA-COM BV , a Private Company with its registered office at Trolieberg 82, 3010 Leuven, VAT BE0729.718.627 , RPR Leuven/Louvain provides its customers with the option of buying products from its webshop.
These General Terms and Conditions (“Terms”) are applicable to all orders placed by a visitor to this e-commerce website (“Customer”). When placing an order via the webshop of CREA-COM BV, Customer must explicitly accept these Terms, whereby Customer agrees to the applicability of these Terms with the exclusion of all other conditions. Additional Customer conditions are excluded, except when explicit accepted beforehand in writing by CREA-COM BV.
Article 2: Price
All prices listed are expressed in EURO, always include VAT and all other required duties or taxes that the Customer must bear.
Any shipping, reservation or administration fees that are charged must be specified separately.
The specified price refers solely to the articles as set out in writing. The accompanying photos are intended as decorative and may contain elements that are not included in the price.
Article 3: Availability
Despite the fact that the online catalogue and e-commerce website are assembled with the utmost care, it is still possible that information may be incomplete, contains material errors, or is not up to date. Obvious mistakes or errors in the product selection are not binding for CREA-COM BV. With respect to the accuracy and completeness of the provided information, CREA-COM BV is solely bound to obligation of means. CREA-COM BV is in no way liable in event of obvious material or printing errors.
If the Customer has specific questions about for instance availability, delivery terms or method, we ask the Customer to contact our customer service department in advance.
The product selection is valid while stocks last and may at any time be changed or withdrawn by CREA-COM BV. CREA-COM BV cannot be held liable for the non-availability of a product. If an offer is for a limited duration or subject to conditions, this will be explicitly stated in the offer.
Article 4: Online purchases
The ordering process will be completed ad followed:
· The Customer adds the chosen product to its cart
· The Customer completes the order and executes the payment (different methods of payment are available)
· The Customer receives the product (subscription) according to the period of the choses subscription; the Customer receives an email including the beginning and ending date of the chosen subscription/the hour and date of the lessons are chosen in consultation (CREA-COM BV guaranties that the lesson will take place within 30 days after payment, if not the Customer will get a total refund of the lesson).

CREA-COM BV is entitled to refuse an order pursuant to a serious breach on the part of the Customer with respect to their orders.
Article 5: Delivery and execution of the agreement
After having ordered a subscription, the Customer will receive an email conformation including the beginning and ending date of the subscription. If the Customer wishes to receive the subscription on a different email address, he can simply inform CREA-COM BV by mailing to aurelie@crea-com.be .
When ordering a lesson, CREA-COM BV will contact the Customer via mail to set a date and hour for the lesson to take place. CREA-COM BV guaranties that the lesson will take place within 30 days after payment, if not the Customer will get a total refund of the lesson.
Articles ordered via this webshop will be delivered in all countries; products (subscriptions) are send digitally via mail.
Delivery occurs by mail (subscriptions) or videoconference (lessons).
Any visible damage to and/or qualitative deficiencies of an article or other deficiency in the delivery must be reported immediately by the Customer to CREA-COM BV.
Article 6: Retention of title
Delivered articles remain the exclusive property of CREA-COM BV until the moment the Customer pays for the goods in full.
The Customer is not allowed to share, copy or spread in any way the documents that are part of the subscription.
Article 7: Right of withdrawal
The provisions of this article apply solely to Customers in their capacity as consumers purchasing articles online from CREA-COM BV.
The Customer has the right to withdraw from this agreement within a period of 14 calendar days without giving reasons.
The right of withdrawal period will expire 14 calendar days after the date the agreement was entered into.
To exercise the right of withdrawal, the Customer must notify CREA-COM BV, Trolieberg 82 – 3010 Leuven, + 32 16 503950, aurelie@crea-com.be in an unambiguous statement (e.g. in writing by post or e-mail) about their decision to withdraw from the agreement.
To comply with the withdrawal period, the Customer must send a notification of their decision to exercise the right of withdrawal before the withdrawal period has expired.
If the Customer has requested that the provision of services start during the withdrawal period, the Customer shall pay an amount for the services provided up to the time that the Customer notified us of their withdrawal from the agreement that is proportional to the full completion of the agreement.
If the Customer withdraws from the agreement, CREA-COM BV shall repay all payments received from the Customer up until that time with a maximum of 14 calendar days of the date that CREA-COM BV was notified by the Customer of their decision to withdraw from the agreement.
CREA-COM BV shall repay the Customer using the same means of payment as the Customer used in the initial transaction, unless the customer explicitly agreed otherwise. In any case, the Customer will not be charged any costs in connection with such repayment.
The Customer may not exercise the right of withdrawal for:
· service contracts after the provision of service has been completed in its entirety;
· the supply of digital content that is not supplied on a tangible medium when the service has started with the explicit prior consent of the Customer and provided the Customer has confirmed that he thereby lost his right of withdrawal
Article 8: Guarantee
The consumer has certain legal rights under the Act of 21 September 2004 concerning protection of consumers when purchasing consumer goods. This statutory guarantee applies from the date of delivery to the first owner. These rights remain in force irrespective of any commercial guarantee.

The personal information you share with us is used only for the following purposes:

· sending the subscription

You have a statutory right to access and eventually correct your personal information. Article 12: Use of cookies

Article 14: Amendments to the Terms
These Terms may be supplemented by other terms and conditions when explicitly referred to, and the general sales terms and conditions of CREA-COM BV. In case of inconsistencies, the present Terms take precedence.
Article 15: Proof
The Customer accepts that electronic communications and backups shall serve as furnishing of proof.
Article 16: Applicable law - jurisdiction
Belgian law is applicable with the exception of the stipulations of private international law with respect to applicable law and with the exception of the Vienna Convention on the International Sale of Goods. Unless the Customer is a consumer, only the courts of the LEUVEN/LOUVAIN district have jurisdiction in the case of any disputes.

Artikel 1: Algemene bepalingen
De e-commerce website van CREA-COM, een BV met maatschappelijke zetel te Trolieberg 82 te 3010 Leuven, BTW BE 0729.718.627, RPR Leuven, biedt haar klanten de mogelijkheid om de diensten via haar webwinkel online aan te kopen.
Onderhavige Algemene Voorwaarden ("Voorwaarden") zijn van toepassing op elke bestelling die geplaatst wordt door een bezoeker van deze e-commerce website (“Klant”). Bij het plaatsen van een bestelling via de webwinkel van CREA-COM BV moet de Klant deze Voorwaarden uitdrukkelijk aanvaarden, waarmee hij instemt met de toepasselijkheid van deze Voorwaarden, met uitsluiting van alle andere voorwaarden. Bijkomende voorwaarden van de Klant worden uitgesloten, behoudens wanneer deze voorafgaandelijk, schriftelijk en uitdrukkelijk door CREA-COM BV aanvaard zijn.
Artikel 2: Prijs
Alle vermelde prijzen zijn uitgedrukt in EURO, steeds inclusief BTW en alle andere verplicht door de Klant te dragen taksen of belastingen.
Indien leverings-, reservatie- of administratieve kosten worden aangerekend, wordt dit apart vermeld.
De opgave van prijs slaat uitsluitend op de artikelen zoals het woordelijk wordt omschreven. De bijhorende foto’s zijn decoratief bedoeld en kunnen elementen bevatten die niet inbegrepen zijn in de prijs.
Artikel 3: Aanbod
Ondanks het feit dat de online shop en de e-commerce website met de grootst mogelijke zorgvuldigheid worden samengesteld, is het toch mogelijk dat de aangeboden informatie onvolledig is, materiële fouten bevat, of niet up-to-date is. Kennelijke vergissingen of fouten in het aanbod binden CREA-COM BV niet. CREA-COM BV is wat de juistheid en volledigheid van de aangeboden informatie slechts gehouden tot een middelenverbintenis. CREA-COM BV is in geen geval aansprakelijk ingeval van manifeste materiële fouten, zet- of drukfouten.
Wanneer de Klant specifieke vragen heeft over bv. beschikbaarheid, leveringstermijn of leveringswijze, verzoeken wij de Klant om vooraf contact op te nemen met onze klantendienst.
Het aanbod geldt steeds zolang de voorraad strekt en kan te allen tijde worden aangepast of ingetrokken door CREA-COM BV. CREA-COM BV kan niet aansprakelijk gesteld worden voor het niet beschikbaar zijn van een product. Indien een aanbod een beperkte geldigheidsduur heeft of onder voorwaarden geschiedt, wordt dit nadrukkelijk in het aanbod vermeld.
Artikel 4: Online aankopen
De bestelprocedure verloopt als volgt:
· De Klant plaatst het gekozen product in het winkelwagentje
· De Klant rondt de bestelling af en betaalt het bedrag(keuze uit onderstaande betaalwijzen)
· De Klant ontvangt het product (abonnement) volgens de gekozen periode; de Klant krijgt een mail met de begin- en einddatum van het gekozen abonnement / voor de aankoop van een lesmoment wordt de datum in onderling overleg gekozen (CREA-COM BV garandeert de les te laten doorgaan binnen de 30 dagen na de bestelling/betaling, zo niet wordt het volledige bedrag teruggestort aan de Klant)
De Klant heeft de keuze tussen de volgende betaalwijzen
· via kredietkaart
· via bankkaart
· via overschrijving op rekeningnummer BE 19 7360 5633 2412
CREA-COM BV is gerechtigd een bestelling te weigeren ingevolge een ernstige tekortkoming van de Klant met betrekking tot bestellingen waarbij de Klant betrokken is.
Artikel 5: Levering en uitvoering van de overeenkomst
Van zodra de Klant een abonnement besteld heeft, krijgt hij van CREA-COM BV een bevestigingsmail met daarin de begin- en einddatum van het abonnement. Indien de klant het abonnement op een ander mailadres dan het gebruikte voor de aankoop wenst te ontvangen, kan hij dat laten weten aan CREA-COM BV via aurelie@crea-com.be.
Wanneer de Klant een lesmoment bestelt, zal CREA-COM BV contact opnemen via mail om een concrete lesdatum af te spreken. CREA-COM BV verbindt zich ertoe de les te laten doorgaan binnen de 30 dagen na betaling van de les, zo niet wordt het volledige bedrag teruggestort aan de Klant.
Artikelen besteld via deze webwinkel worden geleverd in alle landen; de producten (abonnementen) worden digitaal geleverd via e-mail.
De levering gebeurt via mail (abonnementen) of videoconferentie (lessen).
Elk probleem betreffende ontvangst of kwalitatieve tekortkoming van documenten binnen het abonnement, moeten door de Klant onverwijld worden gemeld aan CREA-COM BV.
Artikel 6: Eigendomsvoorbehoud
De geleverde artikelen blijven tot op het moment van gehele betaling door de Klant, de exclusieve eigendom van CREA-COM BV.
De Klant mag op geen enkele wijze de documenten van het abonnement verspreiden, kopiëren of doorsturen.
Artikel 7: Herroepingsrecht
De bepalingen van dit artikel gelden enkel voor Klanten die in hun hoedanigheid van consument artikelen online aankopen bij CREA-COM BV.
De Klant heeft het recht om binnen een termijn van 14 kalenderdagen zonder opgave van redenen de overeenkomst te herroepen.
De herroepingstermijn verstrijkt 14 kalenderdagen na de dag van de sluiting van de overeenkomst.
Om het herroepingsrecht uit te oefenen, moet de Klant CREA-COM BV, Trolieberg 82 te 3010 Leuven, + 32 16 503950, aurelie@crea-com.be via een ondubbelzinnige verklaring (bv. schriftelijk per post of e-mail) op de hoogte stellen van zijn beslissing de overeenkomst te herroepen.
Om de herroepingstermijn na te leven moet de Klant zijn mededeling betreffende zijn uitoefening van het herroepingsrecht verzenden voordat de herroepingstermijn is verstreken.
Als de Klant heeft verzocht om de verrichting van diensten te laten beginnen tijdens de herroepingstermijn, betaalt de Klant een bedrag dat evenredig is aan hetgeen op het moment dat hij ons ervan in kennis heeft gesteld dat hij de overeenkomst herroept reeds geleverd is, vergeleken met de volledige uitvoering van de overeenkomst.
Indien de Klant de overeenkomst herroept, zal CREA-COM BV alle tot op dat moment van de Klant ontvangen betalingen aan de Klant terugbetalen binnen maximum 14 kalenderdagen nadat CREA-COM BV op de hoogte is gesteld van de beslissing van de Klant om de overeenkomst te herroepen.
CREA-COM BV betaalt de Klant terug met hetzelfde betaalmiddel als waarmee de Klant de oorspronkelijke transactie heeft verricht, tenzij de Klant uitdrukkelijk anderszins heeft ingestemd; in ieder geval zullen de Klant voor zulke terugbetaling geen kosten in rekening worden gebracht.
De Klant kan het herroepingsrecht niet uitoefenen voor:
· dienstenovereenkomsten na de volledige uitvoering van de dienst;
· de levering van digitale inhoud die niet op een materiële drager is geleverd, als de uitvoering is begonnen met uitdrukkelijke voorafgaande toestemming van de Klant en mits de Klant heeft erkend dat hij zijn herroepingsrecht daarmee verliest;
Artikel 8: Garantie
Krachtens de wet van 21 september 2004 betreffende de bescherming van de consumenten bij verkoop van consumptiegoederen heeft de consument wettelijke rechten. Deze wettelijke garantie geldt vanaf de datum van levering aan de eerste eigenaar. Elke commerciële garantie laat deze rechten onverminderd.

Artikel 10: Sancties voor niet-betaling
Niet van toepassing: betaling gebeurt steeds voor de levering.
Artikel 11: Privacy
De verantwoordelijke voor de verwerking, CREA-COM BV respecteert de Belgische wet van 8 december 1992 met betrekking tot de bescherming van het privéleven in de verwerking van de persoonlijke gegevens.
De door u meegedeelde persoonsgegevens zullen enkel gebruikt worden voor volgende doeleinden:
· de uitvoering van de afgesloten overeenkomst
· het verwerken van de bestelling
· versturen van nieuwsbrieven
· informatie over diensten/producten aangeboden door CREA-COM BV (reclame)
U beschikt over een wettelijk recht op inzage en eventuele correctie van uw persoonsgegevens. Mits bewijs van identiteit (kopie identiteitskaart) kunt u via een schriftelijke, gedateerde en ondertekende aanvraag aan CREA-COM BV, Trolieberg 82 te 3010 Leuven, + 32 16 503950, aurelie@crea-com.be , gratis de schriftelijke mededeling bekomen van uw persoonsgegevens. Indien nodig kunt u ook vragen de gegevens te corrigeren die onjuist, niet volledig of niet pertinent zouden zijn.
In geval van gebruik van gegevens voor direct marketing: U kan zich kosteloos verzetten tegen het gebruik van uw gegevens voor direct marketing. Hiertoe kan U zich steeds richten tot CREA-COM BV, Trolieberg 82 te 3010 Leuven, + 32 16 503950, aurelie@crea-com.be .
Wij behandelen uw gegevens als vertrouwelijke informatie en zullen die niet doorgeven, verhuren of verkopen aan derden.
De klant is zelf verantwoordelijk voor het vertrouwelijk houden van zijn logingegevens en het gebruik van zijn paswoord. Uw paswoord wordt gecodeerd opgeslagen, CREA-COM BV heeft dus geen toegang tot uw paswoord.
CREA-COM BV houdt online (anonieme) bezoekersstatistieken bij om te kunnen bekijken welke pagina’s van de internetsite in welke mate bezocht worden.

Artikel 12: Gebruik van cookies
Tijdens een bezoek aan de site kunnen 'cookies' op de harde schijf van uw computer geplaatst worden. Artikel 13: Aantasting geldigheid - niet-verzaking
Indien een bepaling van deze Voorwaarden ongeldig, onwettig of nietig wordt verklaard, zal dit op geen enkele wijze de geldigheid, de wettigheid en de toepasbaarheid van de andere bepalingen aantasten.
Het nalaten op gelijk welk moment door CREA-COM BV om één van de in deze Voorwaarden opgesomde rechten af te dwingen, of gelijk welk recht hiervan uit te oefenen, zal nooit gezien worden als een verzaking aan zulke bepaling en zal nooit de geldigheid van deze rechten aantasten.
Artikel 14: Wijziging voorwaarden
Deze Voorwaarden worden aangevuld door andere voorwaarden waar expliciet naar verwezen wordt, en de algemene verkoopsvoorwaarden van CREA-COM BV. Ingeval van tegenstrijdigheid, primeren onderhavige Voorwaarden.
Artikel 15: Bewijs
De Klant aanvaardt dat elektronische communicaties en back-ups als bewijsvoering kunnen dienen.
Artikel 16: Toepasselijk recht – Geschillen
Het Belgisch recht is van toepassing, met uitzondering van de bepalingen van internationaal privaatrecht inzake toepasselijk recht.
De rechtbanken van de woonplaats van de Consument zijn bevoegd bij gerechtelijke geschillen. De Consument kan zich ook wenden tot het ODR-platform (http://ec.europa.eu/consumers/odr/).
